I think this is a difficult topic, bcesuae often it seems the right to free speech is often conflated with the idea that no one can limit the forum for speech. I don't know any more of the details than what you presented, but one could argue in the MTA example that there was no ban on the speech itself, only on the forum in which the speech could be presented. I think that when the Founding Fathers were planning what was essentially insurrection against England, they didn't expect to be able to print it in the local paper. Instead, they found underground ways of getting their message out. And in this present day, with all the communication media at a person's disposal, it would be pretty difficult to suppress their speech.That said, I do think there are difficult times ahead, especially for religious institutions. Recently in Ontario, Canada, the Education Minister said that Catholic schools (which are publicly funded) that it would be against the law to teach that abortion is wrong bcesuae it is misogynistic . . Now this is a direct suppression of speech by the government!I'm not sure we are in a crisis state yet, but I agree the trend doesn't look good.
